Knicely Argues Case Before Supreme Court of Virginia

On Tuesday, June 4, 2019, attorney James J. Knicely represented Sanjay and Sona Sainani before the Supreme Court of Virginia in their appeal of a ruling of the Loudoun County Circuit Court upholding sanctions by the Belmont Glen Homeowners Association for their display of religious holiday lighting around the front door and deck of their home. The Sainanis contend that the HOA had no authority to enforce the sanctions because the underlying Declaration of Restrictive Covenants was improperly adopted and also because the underlying HOA rules governing the display of holiday lighting were unreasonable and not authorized by the Declaration. A ruling is expected within the next few months.
